Brandigator terms and conditions
Version: 8 October 2026 — for business clients. This is a translation for convenience. The Dutch version is the binding one.
1. Who we are and when these terms apply
Brandigator, Volmerlaan 5, 2288 GC Rijswijk, the Netherlands, Chamber of Commerce 94369488, VAT NL005079240B06, can be reached at john@brandigator.nl. These terms apply to our offers, free visibility scans and agreements with clients acting for their business or profession. Additional statutory rules apply to consumers; separate arrangements have to be made for those.
In these terms, client means the business that takes our service or a product. A written agreement includes confirmation by email. Where a signed quotation or order confirmation differs from these terms, that specific arrangement prevails.
2. The free visibility scan
The free scan carries no obligation and gives a first picture of the online visibility of the business you name. Requesting one does not commit you to buying a paid service. The scan is based on the public information available at that moment and on the data you supply. The outcome is a snapshot in time and not a guarantee of rankings, listings, reviews, revenue or any other result.
The website states a response time of 48 hours. If we cannot meet it for a particular request, we will say so as soon as possible. A paid engagement only comes about once the scope and price have been expressly agreed.
3. Quotations and engagements
A quotation or order confirmation sets out which work or products we deliver, what is and is not included, the price, any third-party costs, the schedule and — for ongoing services — the term and notice period. An engagement starts once the client accepts the offer and Brandigator confirms it. We only carry out changes in scope or additional work after a fresh agreement on the effect on price and schedule.
Prices in a business quotation exclude VAT unless expressly stated otherwise. The quotation states how long the offer is valid.
4. Delivery and cooperation
We carry out the engagement carefully and professionally. The client supplies the information, materials, approvals and access that are reasonably needed. The client warrants that it has the right to use the texts, images, data and accounts it provides for the engagement. Delay caused by missing information or access may shift the schedule; we will raise that in good time.
Where access to a Google Business Profile or another account is needed, we agree which permissions are required. The client remains the owner of its accounts and responsible for its own business data, unless we agree otherwise in writing.
5. Results and third-party platforms
Visibility in Google, Maps and AI answers is partly determined by third-party platforms. Their algorithms, guidelines and availability can change. We therefore cannot guarantee any particular ranking, listing, volume of traffic, number of reviews or revenue. Forecasts and examples are not a promised result. We report relevant limitations that we notice during the engagement.
6. Review Display and reviews
Where an engagement includes a Review Display, the quotation describes which physical product, which link and which support are delivered. An NFC link takes customers to the review page the client designates. Brandigator does not write reviews on behalf of visitors and does not decide whether a platform publishes or removes a review.
The client uses the product to ask for genuine, voluntary experiences , without reward, pressure or filtering for positive responses. Both parties comply with applicable rules and platform guidelines. The client checks that the link and business listing in use stay current.
7. Delivery and feedback
We deliver the agreed work or products in the way set out in the quotation. The client checks the delivery within a reasonable period and reports any concrete error or deviation as soon as possible, so that we can investigate it and — where it falls within the agreed engagement — put it right. New wishes or changes after approval are additional work if we agree so together.
8. Invoicing and payment
Invoicing follows the quotation. Where no payment term has been agreed, an invoice is payable within 14 days of the invoice date. In the event of late payment we first send a reminder and give a reasonable opportunity to pay after all. After that we may, as far as the law allows, charge statutory commercial interest and reasonable collection costs. In the event of a substantial payment arrears we may suspend work after prior notice.
9. Term and ending the collaboration
The term and any notice period of an ongoing service are set out in the quotation. Where nothing is stated about a fixed term, an ongoing engagement may be terminated in writing on one calendar month notice. A fixed engagement ends after the agreed delivery and payment. A fixed term is not tacitly renewed, unless that has been expressly and clearly agreed.
Either party may terminate the agreement if the other is seriously in default and fails to remedy the default within a reasonable period given in writing. Work carried out up to the end, and costs agreed, remain payable. We cooperate reasonably in handing over client material and access once outstanding matters have been settled.
10. Intellectual property and confidentiality
Materials, trademarks and data supplied by the client remain the client's or its licensors'. Our existing methods, templates, software and know-how remain Brandigator's or our licensors'. After payment in full, the client receives the right of use agreed in the quotation to the end products made specifically for it. Transfer of copyright or source files only takes place where expressly agreed in writing.
We treat non-public business information we receive for an engagement as confidential. That does not apply to information that is already public, was lawfully obtained from another source, or must be shared by law. We do not use a client's name or work as a public case study without their permission.
11. Personal data
Our privacy statement applies to personal data for which Brandigator is itself the controller. Where we process personal data of a client's own customers on their instructions, the parties agree the necessary roles, instructions and security arrangements before that processing begins, including a data processing agreement where needed.
12. Liability and force majeure
Where we are in attributable default, we are liable towards a business client for demonstrable, direct loss that was reasonably foreseeable and that has not been remedied after a reasonable opportunity to put it right. As far as the law allows, our liability for a paid engagement is limited to the amount the client paid Brandigator for that engagement in the 12 months before the event causing the loss . This limitation does not apply in the event of intent or wilful recklessness, or where the law does not permit limitation. No guarantee of results applies to the free scan; statutory liability is not excluded by that.
Neither party is responsible for delay caused by an event beyond its reasonable control, such as a prolonged outage at a third-party platform. The affected party informs the other as soon as possible and limits the consequences where it can. If performance becomes permanently impossible, the parties discuss termination and a reasonable settlement.
13. Complaints, changes and governing law
If you have a complaint about our work, email it with a clear description to john@brandigator.nl. We first look for a solution together. We may amend these terms for future quotations; for a running engagement, new terms only apply if the parties agree to them.
Dutch law governs the agreement. If discussion does not resolve a dispute, the parties bring it before the court in the Netherlands that has jurisdiction by law.
